The Multicultural Family Support Center provides interpretation and translation services for migrant workers and marriage immigrants that is provided by marriage immigrants who are fluent in Korean and his/her mother tongue. This service includes counseling for settlement, help in visiting public organizations and other assistance.

Bad language is frequently used in factory settings. Sometimes these individuals are not particularly angry but curse out of habit. It is only natural that you may feel upset you hear bad language or curse words. When it happens, try not to start a fight. Instead, ask the person to stop. If the situation seems likely to escalate into an argument, leave the place and continue to talk later. If the situation is repeated, talk to your employer. If the situation does not improve, contact a counseling center.

The Industrial Accident Compensation Insurance Act provides for the treatment of and compensation for employees. Getting treatment and compensation for an industrial accident often requires complicated procedures and may take a long time depending on the type of the accident and the extent of the injury. In addition, there are many different kinds of documents that must be submitted to the Korea Workers’ Compensation and Welfare Service (KWCWS). If you are unable to obtain sufficient information either from your employer or the hospital or you don’t understand the information provided, please go to a counseling organization and ask for help.
The following is what you should know about industrial accidents.
In general, the employer applies for industrial accident compensation. If your employer does not do this for you, you or your family member can go to the KWCWS and apply for compensation, or go to a counseling organization and ask for help. In case of an accident, the initial treatment is critical. Be sure to be seen and treated by a specialist. Particularly in the case of an accident requiring finger amputation, you must demand to be taken to a hospital that can perform finger re-plantation surgery with the cut-off finger(s) within 24 hours of the accident. If the injury happens while at work, you can still receive compensation even if the accident is a result of your mistake. You can receive your sick leave benefits and disability compensation only through your own bank account. Therefore, if you are injured in an industrial accident and begin to receive treatment, create a bank account immediately and keep your bankbook in a safe place.
While an employee is on sick leave due to an industrial accident, the employer may not terminate his/her employment or force him/her to leave the country. Some foreign employees are forced to leave the country while recuperating from an industrial accident injury because they are not familiar with the law. In some cases, an employee dies from an industrial accident and the family does not receive any compensation because they are not familiar with Korean law. In order to avoid this kind of unfortunate situation, talk to a counseling organization to find out your rights.
(2) Rehabilitation EducationPersons with disabilities caused by industrial accidents are entitled to receive vocational training services at the rehabilitation training center of the Korea Workers' Compensation & Welfare Service if they are diagnosed with Industrial Accident Disability Grade 1 to 14 and aged 50 years or older. Free meals and lodgings and some training allowances are granted to trainees. The vocational training services offered by private training agencies can be also funded by the Korea Workers' Compensation & Welfare Service. If you suffer a disability due to an industrial accident, then you must carefully check the program benefits.
(3) Work Safety▶ Basic Safety Rules
Worksites and neighboring passageways must be frequently cleaned and organized to prevent accidents. All obstacles must be removed from passageways to facilitate traffic while slippery locations must be marked with identification. The following safety standards must be observed at workplaces.
Hazardous materials must be categorized and stored in specified containers at specified locations. Workers must wear protective clothing during operation and shall not smoke or eat at workshops. Workers shall wear safety helmets and boots and use other protective gear. Safety gloves must be used instead of regular cotton gloves before handling rotating machinery. Protective goggles must be used when the cutting, grinding, or machinery works cause dust and residue. Protective (gas) mask shall be used to handle chemicals such as cleaner or adhesive. Emergency exits must be always be available. Workers must be fully aware of the use of first aid kits and fire extinguishers. Workers must be fully aware of the alert messages such as safety or directional signs. Hands must be washed clean before eating.
The present social insurance system applying to workers includes national health insurance, worker accident compensation insurance, unemployment insurance and the national pension. This system applies equally to foreign workers.
(1) National Health InsuranceHealth insurance helps pay for medical costs incurred when you visit hospitals or clinics and both the employer and employed are each required to make equal contribution for payment of the premium.
(2) Accident Compensation InsuranceIndustrial accident insurance helps you pay for treatment and provides compensation if you are injured at work or develop a work-related illness. The premium is paid by your employer.
(3) Unemployment InsuranceUnemployment insurance pays unemployment benefits to temporarily unemployed people. This benefit is generally given to those registering as unemployed, and often on conditions ensuring that they seek work and do not currently have a job, until they find a new job. Both the employer and the employee are required to make equal contribution for payment of the premium. Foreign workers working in Korea under the employment permit system are obliged to buy this insurance by law. If a foreign worker loses a job after working for 180 days or longer in Korea, he/she is entitled to apply for unemployment benefits at the Employment Stabilization Center. However, because of the opinion that foreign workers receive fewer benefits from signing up for this insurance than Koreans do, it is no longer obligatory to sign up.
(4) National PensionUnder the National Pension plan, employees contribute a certain amount of premium until they are 59 years old and start receiving a monthly pension when they turn to 60. The premium is deducted from the employee’s monthly wage. Not all foreign employees are obligated to join. Among the countries under the Employment Permit System, 9 countries (Mongolia, Sri Lanka, Indonesia, Uzbekistan, China, Kazakhstan, Thailand, the Philippines and Kyrgyzstan) are obligated to join the pension plan under the “Convention between the Republic of Korea and the Countries of Origin of Foreign Employees.” Employees from four of these countries (Sri Lanka, Indonesia, Kazakhstan and Thailand [under certain conditions]) can get their contribution back upon leaving Korea. There is an argument currently that applying a national pension plan that provides benefits for retirees aged 60 years or older to foreign employees who will return to their home countries after three years of employment is not appropriate. The decision whether to continue to apply National Pension premiums is expected to be made shortly. Until then, payment into the premium by foreign workers is mandatory.
Foreign workers are eligible for social insurances such as the national pension, national health insurance and unemployment insurance, which are the most beneficial. The insurance premium will be deducted from your wage monthly, which will be paid to social insurance companies by your company.
(2) The Korean Labor Standards ActThe purpose of this law is to set standards for the conditions of labor between employer and employees to secure and improve the living standards of workers and to achieve the well- balanced development of the national economy. The condition of labor will be determined by mutual agreement between employers and workers. It is important to clearly state the terms of employment such as remuneration and type of work in writing when establishing a labor contract.
(3) Protection based on the Labor Standards ActThis act will apply to all businesses or workplaces in which five or more workers are ordinarily employed. For businesses or workplaces which ordinarily employ fewer than five workers, only part of the provisions of this act may be made applicable. Payment of wages must be directly made in full to workers in cash and wages must be paid at least once per month on a fixed day. An employer must pay fifty percent or more of the ordinary wage for extended work, night work or holiday work. Workers who have worked more than one year are entitled to receive a severance payment. If workers did not receive wages or severance, were assaulted by an employer or a supervisor or forced to work for a long period against their will or the labor standards act is violated in the workplace, workers may present a petition to the Labor Improvement Instruction Department of the Regional Office of Labor Relations. (4) Labor StandardsFor workplaces which apply the Revised Labor Standards Act, work hours per week must not exceed forty hours excluding break time and work hours per day must not exceed eight hours excluding breaks. If the parties concerned reach agreement, the work hours may be extended by up to twelve hours a week. For workplaces which do not apply the Revised Labor Standards Act, work hours per week must not exceed forty four hours excluding break time and work hours per day must not exceed eight hours excluding breaks. For small workplaces which ordinarily employ fewer than twenty workers, the work hours per week will be revised to forty hours in 2011.
(5) WageIn order to secure the basic living standards of workers, a minimum wage is fixed by law and is called the Minimum Wage System. All companies must abide by this law. ※As of 2012, the minimum was is 4,580 won per hour, 36,640 won per day and 957,220 won per month.
(6) Severance PaymentSeverance pay is applied only to those who are defined as a worker in the Labor Standards Act Workers who work less than 15 hours a week will not be eligible for the severance system. Workers working in a workplace which ordinarily employs more than 5 workers can receive the severance payment. Workers who have worked over one year are entitled to receive the severance payment.
This system allows companies which have difficulty in finding domestic employees to legally hire migrant workers from 15 countries (The Philippines, Thailand, Indonesia, Sri Lanka, Vietnam, Mongolia, Uzbekistan, Pakistan, Cambodia, China, Bangladesh, Kirgizstan, Nepal, Myanmar and East Timor) that have established MOUs with Korea.
(1) Management of migrant workersThe initial period of employment will be for three years and can be extended yearly. Employers must use a standard employment agreement to hire foreign workers All companies hiring foreign workers are obligated to insure the departure-expiration insurance and the surety insurance or trust for overdue payment. A change of workplace is generally prohibited. Only when the company has temporarily closed or shut down or when an employer cancels the employment agreement for valid reasons are foreign workers able to change their workplace and this is limited to three times.
(2) The protection of the rights and interests of foreign workersThe Labor Law will apply to foreign workers in the same manner as they apply to Koreans and worker compensation insurance, minimum wages and the three labor rights will be guaranteed.
(3) NoticeDo not leave your passport with your employer Never leave your passport, alien registration card or flight tickets with your employer even though he/she asks you to do so. Tell your employer that these items are yours and keep them for yourself. It is fine to give photocopied forms, if asked. Beware of job brokers.
There are many job brokers who will look for a job for you and will receive a reward or monthly commission to do so. However, this is illegal and will be punished by imprisonment for not more than 5 years or by a fine not exceeding 30 million won.
